The Jenny Project Terms and Conditions

1. Acceptance of Terms By accessing or using The Jenny Project’s Services, you affirm that you are at least 18 years old and capable of entering into a legally binding agreement. If you are using the Services on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity to these Terms. If you are using the Services for personal purposes, these Terms apply to you as an individual user.
2. Services Overview
The Jenny Project supports businesses, agencies, and professionals with AI-powered consumer insights tailored to product, brand, and marketing decisions. Common use cases include message testing, concept validation, persona profiling, price sensitivity, and predictive analytics.
The functionality and behavior of our AI-powered features may evolve over time as technology advances. We will notify users of any significant changes.
3. User Accounts
3.1 Account Creation: To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to update your account as necessary.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access or security breach.
3.3 Dashboard Access: Authorized users can access their accounts through a secure client login and dashboard. You are responsible for all activity conducted under your account. You agree not to share your login credentials with unauthorized parties or allow third-party access.
3.4 Dashboard Data: Information displayed within the dashboard is specific to your usage and should not be shared, copied, or distributed without prior written consent from The Jenny Project.
3.5 Dashboard Downtime: We do not guarantee uninterrupted access to the Services and are not liable for disruptions beyond our control. We aim to minimize service interruptions and will provide advance notice for planned downtime whenever possible.
4. Permitted Use
4.1 Compliance: You agree to use the Services in compliance with applicable laws and regulations.
4.2 Secure Access: Users must access the client login and dashboard via secure methods and must not attempt to bypass security measures or access another user’s account.
4.3 Restrictions: You will not:
- Reverse-engineer or attempt to extract the source code of our platform.
- Use the Services for unlawful purposes.
- Interfere with or disrupt the functionality of the Services.
5. Payment and Subscription
5.1 Pricing: Subscribing to a paid plan constitutes agreement to the pricing and billing terms presented at the time of purchase.
5.2 Upgrade Terms: Upgrades take effect immediately upon payment. Any unused simulations or entitlements from a previous plan will not carry over.
5.3 Refunds: Except as provided under Section 5.4, all payments are non-refundable.
5.4 30-Day Opt-Out for New Customers:
First-time customers may cancel within 30 days of their subscription start date by providing written notice to lee.constantine@thejennyproject.com. If usage has not exceeded 25 simulations, a full refund of the unused annual subscription amount. Usage beyond this threshold, or failure to cancel within the 30-day window, will constitute full acceptance of the annual plan.
6. Intellectual Property
6.1 Ownership: All intellectual property rights in the Services, including but not limited to the platform’s design, content, technology, and generated insights, are owned by The Jenny Project.
6.2 License to Use Insights: Users are granted a non-exclusive, non-transferable license to use the insights and outputs generated by The Jenny Project solely for their internal business purposes. Users may not sell, distribute, or otherwise commercialize the insights without prior written consent from The Jenny Project.
6.3 Prohibited Use: Users agree not to:
- Reverse-engineer, copy, or reproduce any part of the Services or generated insights.
- Use the insights for developing competitive products or services.
- Share access to the Services or outputs with unauthorized third parties.
6.4 User Data and Model Improvements: By using the Services, users agree that their input data may be used to improve the underlying AI models. Such data will be anonymized and aggregated to ensure confidentiality. You always have the option to opt out of any usage of your inputs for model improvement — just let us know and we’ll flag your account accordingly.
7. Publicity Rights Unless otherwise agreed in writing, by using The Jenny Project’s Services, you grant us permission to use your company name and logo in our marketing materials—such as our website, pitch decks, and case studies. If you'd prefer we don’t, just let us know anytime and we’ll make sure to exclude it.
8. Disclaimers and Limitations
8.1 No Warranties: The Services are provided "as is" and "as available." We make no warranties regarding their accuracy, reliability, or suitability for your purposes.
8.2 Insights Disclaimer: The insights and recommendations provided by The Jenny Project are based on data and algorithms. They are intended for informational purposes only and should not be construed as guarantees of specific results. Users are encouraged to exercise independent judgment and consult with appropriate professionals before acting on any insights.
8.3 Limitation of Liability: To the fullest extent permitted by law, The Jenny Project shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Services, including reliance on the insights provided.
8.4 Usage Limitations: Insights are not intended for critical decisions, such as legal, medical, or financial advice. Users should verify applicability and seek professional guidance where appropriate.
9. Termination We reserve the right to suspend or terminate your access to the Services at our discretion, including for violations of these Terms. Refunds will be provided at our sole discretion.
10. Governing Law These Terms shall be governed by the laws of the State of Minnesota, without regard to conflict of laws principles.
11. Changes to Terms We may update these Terms from time to time. Any changes will be posted on this page with the updated effective date. Your continued use of the Services constitutes acceptance of the updated Terms.
12. Indemnification You agree to indemnify, defend, and hold harmless The Jenny Project, its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services or violation of these Terms.
13. Modification of Services We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We are not liable for any modifications or interruptions to the Services.
14. Force Majeure The Jenny Project shall not be held liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, government restrictions, natural disasters, or technical failures.
15. Dispute Resolution Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in Minneapolis, Minnesota, and the language of arbitration shall be English.
16. Feedback Policy By submitting feedback or suggestions regarding the Services, you grant The Jenny Project a perpetual, irrevocable, and royalty-free license to use such feedback for any purpose without compensation to you.
17. International Use Users accessing the Services from outside the United States are responsible for compliance with local laws.
18. Compliance with OpenAI Terms of Use and Data Policies
18.1 Compliance with OpenAI's Terms of Use
Certain features of The Jenny Project are powered by OpenAI’s large language models (LLMs) via API access. By using these features, you agree not to use the Services in any manner that would violate OpenAI’s Terms of Use. This includes, but is not limited to:
- Prohibitions against harmful, illegal, or unethical uses of AI;
- Restrictions on using OpenAI's outputs to develop or enhance competing AI models;
- Compliance with OpenAI’s content policies, such as restrictions on generating sensitive or regulated content.
Failure to adhere to OpenAI’s Terms of Use may result in suspension or termination of your access to the Services.
18.2 OpenAI Data Collection Policy
The Jenny Project utilizes OpenAI’s APIs to process user input and generate insights. While OpenAI does not store personal data provided through its API, some data may be temporarily retained for service abuse monitoring and debugging. By using our Services, you agree to OpenAI’s data usage practices as outlined in their API Data Usage Policy.
- Anonymized and Aggregated Data: OpenAI may process data in anonymized and aggregated forms to improve its models. However, they do not use specific customer data submitted via the API to train their models by default.
- User Responsibility: You are responsible for ensuring that any data you submit complies with applicable privacy laws and does not contain sensitive or personally identifiable information.
By accessing The Jenny Project’s AI-powered features, you agree to these practices and acknowledge your responsibility for data compliance.
